Abstract: So far, there is no clear provision for the legal effect of transferring personal commercial insur-ance claim to personal accident insurance in a group. The trial results vary greatly among some similalcases in terms of different laws. We believe that the legal effect of the transfer of personal commercial in.surance claim should be analyzed from the value and function of insurance, and the features of the claimrights for insurance benefits. The judicial practice should also take into consider the subjects, conditionsand intention of the transferor.
